Airbnb Accident Lawyer California | Guest Injury, Host Liability, and the $1 Million Host Protection Coverage
Short answer: If you were injured at an Airbnb, VRBO, or other short-term rental property in California, you may have claims against (1) the Airbnb host directly, (2) Airbnb’s $1 million Host Protection Insurance, (3) the property owner (if different from the host), and (4) any contractors who created the dangerous condition. Settlements for serious Airbnb injuries commonly run $100,000 to $1,000,000+. You have two years to file (CCP §335.1). Call Sky Law Group at (844) 475-9529 — Hablamos Español.
Common Airbnb Injuries in California
- Stairway falls — missing handrails, uneven treads, poor lighting, rotten boards on outdoor stairs
- Balcony collapses — a leading cause of serious Airbnb injuries; many older California properties have corroded or inadequately maintained balcony structures
- Swimming pool and hot tub drownings or injuries — missing safety covers, no fencing, defective pool drains (Virginia Graeme Baker Pool & Spa Safety Act compliance), chemical burns from improper maintenance
- Carbon monoxide poisoning — faulty furnaces, water heaters, fireplaces; California requires CO detectors in all rental dwellings (Health & Safety Code §13261.4)
- Fire injuries — missing or disabled smoke alarms, defective electrical wiring, overloaded circuits, no fire extinguishers
- Slip and fall — wet decks, polished floors with no warning, cluttered walkways
- Trip hazards — uneven flooring, loose rugs, cracked driveways
- Dog bites — host’s pet attacking a guest (California strict liability under Civil Code §3342)
- Assault by criminals — inadequate security, broken locks, hosts giving keys/codes to third parties
- Food poisoning — contaminated well water, improper refrigeration
Airbnb’s $1 Million Host Protection Insurance
Airbnb provides $1,000,000 per occurrence in Host Protection Insurance (currently through Zurich Insurance) that covers:
- Bodily injury to guests, their visitors, and other third parties on the property
- Property damage caused by the host or Airbnb-related activities
- Legal defense of the host
Importantly, this coverage applies even when the host carries no separate liability insurance. Many hosts assume their homeowner’s policy covers Airbnb activity — it usually does NOT, because most homeowner’s policies exclude commercial/business use. Airbnb’s $1M fills that gap.
Who the Airbnb Host Protection does NOT cover:
- The host’s intentional acts
- Pre-existing conditions on the property that the host knew about and failed to disclose
- Pollution claims
- Mold claims (often excluded)
Sky Law Group handles the Airbnb notification process and tenders claims directly to Zurich. Hosts often don’t know how to report, and improperly handled notifications can result in coverage denials.
Beyond Airbnb — Who Else May Be Liable
- The property owner (if different from the host) — property-owner liability for defective conditions under California Civil Code §1714
- Property management company — if a professional manager is involved in maintenance decisions
- Contractors — if construction, electrical, plumbing, or pool work created the dangerous condition
- Pool service companies — for pool-related injuries
- HOA — for common-area injuries in condo/townhome Airbnb rentals
- Prior owner — in some circumstances if the dangerous condition was concealed from the current owner
Host Liability Under California Premises Liability Law
Airbnb hosts are “possessors” of real property under California Civil Code §1714 and owe a duty of reasonable care to invitees (paying guests). This duty requires:
- Reasonable inspection of the property
- Warning guests of known dangerous conditions
- Repair of dangerous conditions, or at minimum, protecting guests from them
- Compliance with California habitability laws (Civil Code §1941), fire codes, and safety regulations
Hosts cannot waive this liability through boilerplate Airbnb house rules. California Civil Code §1668 voids liability waivers for ordinary negligence in most consumer transactions, and Airbnb’s standard terms do not shield hosts from liability for their own negligence.
Common Defenses — and How We Beat Them
- “The guest signed the house rules.” California Civil Code §1668 voids broad liability waivers. House rules are not a get-out-of-liability-free card.
- “The dangerous condition was open and obvious.” California’s modern approach limits this defense — hosts must consider whether distracted guests, especially out-of-town tourists unfamiliar with the property, could reasonably avoid the hazard.
- “The guest was drinking.” California’s pure comparative negligence reduces but does not bar recovery.
- “Airbnb isn’t responsible — the host is.” Airbnb’s $1M Host Protection covers these claims regardless of the host-vs-platform liability dispute.
- “My homeowner’s policy will cover it.” Usually it won’t — Airbnb activity is a commercial use that most homeowner’s policies exclude.
What to Do After an Airbnb Injury
- Get emergency medical care — ER, not urgent care
- Photograph everything — the hazard, surrounding area, your injuries, any warning signs (or absence)
- Preserve the listing and all messages with the host — screenshot the Airbnb listing, host communications, house rules, and photos the host posted
- Report the injury to Airbnb through the app within 24 hours — this triggers the Host Protection claim process
- Do NOT accept Airbnb’s initial settlement offer — their internal “resolutions” team is designed to minimize payouts
- Call Sky Law Group — we handle the Airbnb/Zurich notification and preserve evidence before the host “fixes” the dangerous condition
