Police do not always come to a crash scene, especially when they are busy or the damage looks minor. Sometimes the other driver begs you not to call, or you leave quickly because you are in shock. Without a police report, many people assume their claim is over. It is not.

A police report is helpful evidence, but it is not required to bring an injury claim in California. What matters is that you can prove what happened, and there are several ways to do that.

Do You Need a Police Report to File a Claim?

No. An insurance claim or injury lawsuit can be built from other evidence. A police report simply makes the insurer’s job easier, so adjusters sometimes act as if it is required. It is not.

  • Photos and video of the vehicles, plates, damage, road and injuries
  • Witness names and phone numbers, and written statements while memories are fresh
  • Dashcam, doorbell, traffic and business surveillance video, which is often erased within days
  • Medical records showing when you first sought care and what you reported
  • The other driver’s information, including license, plate and insurance

Reports You Should Still Make

California law requires drivers to report certain crashes to the DMV. Under Vehicle Code §16000, a driver generally must file a report within ten days if anyone was hurt or killed, or if property damage exceeded $1,000. Your insurer may also require prompt notice. If police did not come, you can ask the local police department or the California Highway Patrol whether a report can still be filed, depending on where the crash happened.

Do not rely on the other driver’s promise to “take care of it” privately. Drivers who say that often disappear, change their story or give a different version to their insurer.

How Sky Law Group Can Help

We can request any records that exist, send preservation letters for video, identify the other driver’s insurance and speak with insurers so you do not have to. If the other driver fled, see our guide to hit-and-run accidents in Orange County.

What to Do Right Now

  1. Get medical care, even if you feel fine. Some injuries show up hours or days later.
  2. Document everything: photos, plates, insurance cards, witness names and phone numbers.
  3. Report the crash and keep the report number. See our guide on insurance adjuster tricks before you talk to any insurer.
  4. Do not admit fault or sign a release until you understand what your claim is worth. Read should I give a recorded statement?
  5. Call Sky Law Group for a free consultation: (844) 475-9529.

California Filing Deadlines

Most California injury lawsuits must be filed within two years of the injury (Code of Civil Procedure §335.1). If a city, county or other public entity is involved, a claim generally must be presented within six months (Government Code §911.2). Read our statute of limitations guide. Every case is different and no result can be guaranteed.

Frequently Asked Questions

Can I still get compensation if police never came to my accident?

Often yes. Photos, witness statements, video and medical records can prove what happened even without a police report.

What if the other driver admitted fault at the scene?

An admission can help, but it is easy to deny later. Write down what was said and who heard it, and call us before you speak with the other driver’s insurance.

What if the other driver gave me fake information?

Tell us right away. We can use plate numbers, video and your own insurance coverage, including uninsured motorist coverage, to look for options.

How much does it cost to hire Sky Law Group?

The consultation is free and we work on contingency, so you pay no attorney fee unless we recover compensation for you.
