Elder Abuse Attorney Orange County | Nursing Home Neglect, Financial Exploitation & Enhanced Damages
Short answer: California’s Elder Abuse and Dependent Adult Civil Protection Act (Welfare & Institutions Code §15600 et seq.) is one of the most powerful plaintiff statutes in the country. When elder abuse is proven by clear and convincing evidence, the law provides enhanced damages — including pre-death pain and suffering (not available in regular wrongful death cases), attorney fees, and the possibility of punitive damages up to triple actual damages. Orange County has more than 300,000 residents over 65 and dozens of nursing facilities with documented neglect patterns. Call Sky Law Group at (844) 475-9529 — Hablamos Español.
Types of Elder Abuse Under California Law
Physical Abuse (W&I Code §15610.63)
Assault, battery, use of unreasonable physical restraints, prolonged food/water deprivation, sexual assault, and unreasonable confinement. Signs: unexplained bruises, bedsores (pressure ulcers), broken bones, fear around specific staff.
Neglect (W&I Code §15610.57)
The failure to provide reasonable care — the most common form of elder abuse in Orange County nursing facilities. Common examples:
- Pressure ulcers (bedsores) — Stage 3 and 4 ulcers are usually presumptive evidence of neglect
- Dehydration and malnutrition — Weight loss, electrolyte imbalance, UTIs from inadequate fluids
- Medication errors — Missed doses, wrong drugs, dangerous interactions
- Falls — Due to inadequate supervision, missing bed rails, or failure to follow fall-prevention plans
- Failure to monitor — Resulting in missed heart attacks, strokes, sepsis
- Inadequate hygiene — Infections from unchanged diapers, unwashed bodies, contaminated feeding tubes
Financial Abuse (W&I Code §15610.30)
Taking, hiding, or wrongfully using an elder’s property or money. Common examples:
- Caregiver depleting bank accounts or credit cards
- “Trust” family members or new “friends” being added to accounts
- Fraudulent deed transfers of the elder’s home
- Changed estate plans under suspicious circumstances
- Investment scams and reverse mortgage fraud
- Powers of attorney abused by named agents
Mental Suffering (W&I Code §15610.53)
Fear, agitation, confusion, or emotional distress caused by threats, intimidation, isolation from family, or verbal abuse. Often paired with physical or financial abuse.
Why California’s Elder Abuse Act Is So Powerful
1. Pre-Death Pain and Suffering Damages
In an ordinary wrongful death case, surviving family members cannot recover for the pain and suffering the decedent experienced before death. Under W&I Code §15657, when elder abuse is proven, the decedent’s pain and suffering IS recoverable. This can increase case value by hundreds of thousands or millions.
2. Mandatory Attorney Fees
When elder abuse liability is established, W&I Code §15657(a) requires the defendant to pay the plaintiff’s reasonable attorney fees and costs. This means facilities face unlimited exposure once they lose on liability.
3. Enhanced Punitive Damages
Punitive damages are allowed under California Civil Code §3294 for malice, oppression, or fraud. In elder abuse cases, these punitive damages can be up to triple actual damages or more depending on the defendant’s net worth. Nursing home chains with net worth in the hundreds of millions face huge punitive exposure.
4. Lower Burden Than Fraud
The “recklessness” standard for enhanced elder abuse damages is easier to meet than fraud. A pattern of understaffing that caused predictable neglect can satisfy the recklessness element without proving specific intent.
Orange County Facilities with Documented Problems
Sky Law Group has handled cases involving nursing homes, assisted living facilities, memory care units, and in-home care across Orange County. Facilities range from CMS 5-star to 1-star ratings. CMS’s Care Compare and the California Department of Public Health inspection reports are starting points — but documented complaints don’t tell the whole story. Many facilities with “good” ratings have underlying patterns.
What to Do If You Suspect Elder Abuse
- Document everything — photographs of bruises, wounds, bedsores, living conditions, medication records
- Preserve medical records — hospital visits, ER admits, specialist consults, lab results
- Report to Adult Protective Services (APS) — 1-800-451-5155 (Orange County)
- Report to the California Department of Public Health for licensed facilities
- Remove the elder from immediate danger if possible
- Call Sky Law Group — we send investigators and preserve evidence before the facility destroys it
Statute of Limitations
Elder abuse civil claims have a 2-year statute of limitations under CCP §335.1. For claims involving fraud or financial abuse, the statute may extend to 4 years under CCP §338. For wrongful death from elder abuse, 2 years from the date of death. Government-run facilities (county, VA) require administrative claim filing within 6 months.
