Hit by a Semi-Truck in Orange County? The First 48 Hours

Oct 18, 2026 - Uncategorized by

Short answer: if a semi-truck hit you in Orange County, the trucking company’s policy is at least $750,000 (49 CFR § 387.9) versus California’s $30,000-per-person car minimum, you have 2 years to sue (CCP § 335.1), and the driver’s electronic logs can be legally deleted after just 6 months. The first 48 hours after a semi-truck crash

A loaded tractor-trailer can weigh 80,000 pounds, about 20 times a sedan. When one hits a car on the 91 near Anaheim, the Orange Crush (the 5, 22 and 57 interchange by Katella and Chapman), the 405 in Costa Mesa or the 57 in Fullerton, injuries are usually severe. Orange County’s Level I trauma center is UCI Medical Center; St. Joseph Hospital in Orange and Hoag in Newport Beach also treat serious injuries.

  • Call 911 and accept the ambulance even if you “feel fine.” Adrenaline hides fractures, internal bleeding and brain injuries.
  • Photograph everything: both vehicles, plates, the USDOT and MC numbers on the cab door, the trailer (often owned by a different company), the road, skid marks and the weather.
  • Get witness names and phone numbers. Police reports often miss them.
  • Do not give a recorded statement to the trucking company’s insurer or investigator. See what to do when the trucking company’s investigator calls.

The evidence clock: federal retention rules

Trucking cases are won on evidence that federal law lets the carrier delete early:

  • Driver alcohol and drug testing, 49 CFR § 382.303: post-crash alcohol tests are due within 8 hours and drug tests within 32 hours. After that the window closes.
  • Hours-of-service logs and ELD data, 49 CFR § 395.8(k)(1): retained only 6 months, while your lawsuit deadline is 2 years. The proof of a fatigued driver can legally disappear about 18 months before your case expires. The rules limit driving to 11 hours inside a 14-hour window (49 CFR § 395.3), and § 392.3 bars driving while ill or fatigued.
  • Engine control module (“black box”): speed, braking and throttle data with no federal retention rule. It can be overwritten once the truck is back on the road.

An attorney sends a preservation (spoliation) letter naming each item. California has no stand-alone tort for destroying evidence (Cedars-Sinai Medical Center v. Superior Court (1998) 18 Cal.4th 1), so the letter is what makes later destruction sanctionable under Evidence Code § 413 and CCP § 2023.030.

Who can be liable

Rarely just the driver. Depending on the facts: the motor carrier (vicarious liability, Civil Code § 2338, plus negligent hiring or supervision), the trailer owner, the shipper or loader who overloaded or badly secured cargo, a maintenance shop, or a parts manufacturer. Each can carry its own policy. Port-related crashes on the 91 and 5 are covered in port container truck accidents in Orange County.

California follows pure comparative negligence, so even if you are assigned some fault your recovery is reduced, not barred. See comparative negligence in California. For the full overview, visit our truck accident lawyer in Orange County page and the car accident lawyer hub.

What your claim can include

Damages What it covers

No honest lawyer quotes a number before reviewing your records. What is true: serious-injury claims against commercial policies are valued very differently from fender-benders, and insurers offer less when you are unrepresented. Head injuries are covered in brain injury lawyer; deadlines in California’s statute of limitations. If a city or public agency was involved, the claim deadline is only six months (Gov. Code § 911.2).

What the trucking insurer won’t tell you

They will not tell you that a “quick” offer is usually a fraction of full value, that your recorded statement will be used to shrink your claim, or that you can decline to give one. Read more about trucking insurer lowball tactics (Spanish).

Frequently asked questions

How long do I have to sue after a semi-truck accident in California?

Two years from the accident under CCP § 335.1. Claims involving a public entity require a government claim within six months (Gov. Code § 911.2).

How much insurance does a commercial truck carry?

At least $750,000 for general freight under 49 CFR § 387.9, more for oil or hazardous materials. Some carriers carry larger policies.

What evidence do I need to preserve?

Photos, witness contacts, medical records, and a preservation letter to the carrier covering ELD logs, ECM data, driver qualification files and drug test results.

Can I recover if I was partly at fault?

Yes. California’s pure comparative negligence rule reduces your recovery by your percentage of fault; it does not bar it.

Who pays my medical bills while the case is pending?

Health insurance, MedPay or providers treating on a lien may cover bills while the claim proceeds. Your attorney can explain the options for your situation.

Should I talk to the trucking company’s investigator?

Not without your attorney. Their job is to protect the carrier. Politely decline and refer them to counsel.

What if the truck driver was an independent contractor?

The carrier may still be liable depending on control and registration facts, and other parties may carry coverage. It requires investigation.

Does immigration status affect my claim?

No. You have the right to pursue compensation for your injuries, and your consultation with us is confidential.

How much is my truck accident case worth?

It depends on injuries, medical costs, lost income and fault. We evaluate cases free of charge, with no obligation.

What if a family member died in the crash?

Certain relatives may bring a wrongful death claim, generally within two years. Call us promptly to protect evidence.
