Being hurt as a passenger is one of the most awkward injury situations: the driver may be your friend, your sibling or your coworker. Many passengers worry that a claim means suing someone they care about. In practice, these claims are normally paid by insurance, not out of the driver’s pocket.
Sky Law Group helps passengers understand who is responsible and how to protect their claim without damaging relationships.
Can a Passenger Make a Claim in California?
Yes. As a passenger, you did not cause the crash, and California law allows an injured passenger to pursue compensation from a driver who was negligent. That can be the driver of your own car, the driver of the other car, or both.
- If your driver caused the crash, the claim is usually made against the driver’s auto liability insurance.
- If the other driver caused it, you can claim against that driver’s insurer.
- If both drivers share blame, you may be able to claim against both policies.
Your own policy’s medical payments coverage may also help, and uninsured or underinsured motorist coverage may apply when the at-fault driver has little or no insurance. See MedPay vs. health insurance.
Why Passengers Should Not Wait
- Insurers may call you quickly for a recorded statement. Talk with a lawyer first.
- Both drivers’ insurers may blame each other, and passengers get caught in the middle.
- Evidence disappears quickly: skid marks, traffic video and witness memories fade.
- Medical bills pile up, and a treatment gap can be used to downplay your injuries.
What You May Be Able to Recover
Compensation can include medical bills, future treatment, lost income, pain and suffering, and other losses. Each case is different and no result can be guaranteed. If a rideshare, taxi or bus was involved, different rules and insurance may apply. See our page on Uber and Lyft passenger accidents.
What to Do Right Now
- Get medical care, even if you feel fine. Some injuries show up hours or days later.
- Document everything: photos, plates, insurance cards, witness names and phone numbers.
- Report the crash and keep the report number. See our guide on insurance adjuster tricks before you talk to any insurer.
- Do not admit fault or sign a release until you understand what your claim is worth. Read should I give a recorded statement?

California Filing Deadlines
Most California injury lawsuits must be filed within two years of the injury (Code of Civil Procedure §335.1). If a city, county or other public entity is involved, a claim generally must be presented within six months (Government Code §911.2). Read our statute of limitations guide. Every case is different and no result can be guaranteed.

Frequently Asked Questions
Am I at fault if I was only a passenger?
Generally no. A passenger rarely causes the crash, although in unusual cases, such as grabbing the wheel or knowingly riding with a driver who was clearly impaired, an insurer may argue some shared responsibility.
Will filing a claim hurt my friend or family member who was driving?
These claims are normally paid by the driver’s insurance company, not personally by the driver. We can explain how the process works before you decide.
What if neither driver has insurance?
You may still have options, including your own uninsured motorist coverage. Call us and we will review every policy that could apply.
How much does it cost to hire Sky Law Group?
The consultation is free and we work on contingency, so you pay no attorney fee unless we recover compensation for you.
