Pregnant in a Car Accident in Orange County? Your Rights & Claim Value

Oct 26, 2026 - Uncategorized by

Short answer: Yes. If you were pregnant when another driver hit you, you can claim your own injuries and the added medical care, monitoring, and distress that come with a pregnancy, and California treats an unborn child’s later claim seriously (Civil Code §29). Cases range from about $10,000–$50,000 for ER monitoring with no complications to six or seven figures when the pregnancy is harmed. Why even a “minor” crash is different when you are pregnant

Doctors do not wait for visible injuries after a crash in pregnancy. Sudden force can cause placental abruption, where the placenta separates from the uterine wall, sometimes with no pain at first. That is why obstetric guidance generally calls for evaluation and fetal monitoring after a collision, often for several hours, even when you feel fine. If you were rear-ended on Tustin Street at Katella or on the 55 through Orange, tell the ER or labor-and-delivery triage that you are pregnant before anything else.

Insurance adjusters notice what is missing from your chart. If you skipped monitoring because you “felt okay,” they will say you were not hurt. If you delayed care, they will say the later symptoms are unrelated. Our guide to delayed pain after a rear-end accident explains why late symptoms are normal and how they are used against injured people.

What to do in the first 24 hours

  • Get evaluated the same day. St. Joseph Hospital in Orange, UCI Medical Center on City Drive, and Hoag all have obstetric care; call your OB’s after-hours line if you are unsure.
  • Report cramping, bleeding, fluid leaking, reduced movement, back pain, or contractions immediately.
  • Ask for the monitoring records and keep every discharge paper.
  • Photograph the vehicles, your seatbelt marks, and the scene. Note nearby businesses with cameras, because footage is often overwritten in days.
  • Do not give the other driver’s insurer a recorded statement. See should I give a recorded statement to the insurance company.

What you can claim in California

Your claim is built from the same categories as any car accident case, with pregnancy-specific costs added:

  • Medical expenses for ER care, monitoring, imaging, follow-up OB visits, and any high-risk care. Past medical damages are generally limited to amounts actually paid or incurred (Howell v. Hamilton Meats, 2011).
  • Lost income, including time off for bed rest or appointments. See how to prove lost wages in Orange County.
  • Pain, suffering, and emotional distress, including the fear and anxiety during the weeks you wait to know whether the pregnancy is safe.
  • The child’s own claim if the baby is born with an injury connected to the crash. Civil Code §29 treats a child conceived but not yet born as an existing person for the child’s interests if later born, and the deadline for a minor’s claim can work differently (CCP §352). Every case is different, so get it reviewed.
  • Loss of a pregnancy. This is a deeply painful situation with specialized legal rules. We handle it with care and will explain what claims may be available.

Illustrative ranges (not a promise)

Situation Typical range seen
ER visit and monitoring, no complications, short soreness $10,000 – $50,000
Hospital admission, bed rest, or high-risk pregnancy care $50,000 – $250,000
Premature delivery or a child with crash-related injury $250,000 – $1,000,000+, driven by lifetime care
Loss of pregnancy or permanent injury Case-specific; depends on the facts and available coverage

What the insurance company will not tell you

Adjusters know a clean ultrasound can be used to argue “no injury.” They may also say monitoring was “unnecessary” or that your later complications came from pregnancy itself. A fast, early offer is often priced before anyone knows the outcome. Once you sign a release, the claim ends, even if complications appear weeks later. Deadlines and fault

The general deadline to sue is two years (California statute of limitations, CCP §335.1). If a city, county, OCTA bus, or Caltrans roadway is involved, Gov. Code §911.2 allows only six months to present a claim. If you were partly at fault, you may still recover under comparative negligence. Seatbelt use during pregnancy is expected; wear the lap belt low under the belly and the shoulder belt across the chest, and never skip it.

Frequently asked questions

Can I file a claim if I was pregnant in a car accident in California?

Yes. You can recover for your injuries, pregnancy-related medical care, lost income, and emotional distress, and a child born with crash-related injuries may have a separate claim.

Should I go to the ER even if I feel fine?

Yes. Placental problems can occur without early symptoms, and doctors generally recommend evaluation and monitoring after a crash during pregnancy. It also creates the record your claim needs.

How much is a pregnancy car accident claim worth?

It depends on the medical outcome. Cases with monitoring only often fall in the tens of thousands, while cases involving complications, premature birth, or injury to the child can reach much higher.

Does it matter if the crash was minor?

Medically, yes, it can matter. Legally, the damage to your car does not decide your injury claim, though adjusters often argue it does.

Can my baby have a separate claim?

Possibly. California law protects a child’s interests if later born alive (Civil Code §29), and a minor’s deadline may differ (CCP §352). Have the case reviewed.

What if I was partly at fault?

You can still recover. California uses pure comparative negligence, so your recovery is reduced by your percentage of fault.

Should I talk to the other driver’s insurance?

Not before getting advice. Do not give a recorded statement or sign a release.

How long do I have to file?

Two years from the crash in most cases (CCP §335.1), or six months for a government claim (Gov. Code §911.2).

Does immigration status affect my claim?

No. Evidence Code §351.2 bars immigration status from being admitted or discovered in a personal injury case, and we do not ask.
