Short answer: No — you do not have to give the other driver’s insurance company a recorded statement, in English or any language, and doing so without a lawyer is one of the most common ways Orange County claims shrink from $60,000 to $9,000. Your own insurer can require reasonable cooperation under your policy, but you may ask for an interpreter and for time to get advice. The injury deadline is two years (CCP §335.1). The phone call that arrives before the pain does
It is 9:40 a.m., two days after a crash at Chapman Avenue and Glassell Street in Old Towne Orange. Your neck is tight, your car is at a shop on Katella, and an adjuster you have never met is calling in rapid English: “This call is being recorded. Can you tell me in your own words what happened?” She sounds kind. She is not your friend. Her job is to close the file for as little as possible, and your first words on that recording become Exhibit A.
If English is your second language, the risk is bigger. A hesitation, a mistranslated word, or a polite “yes” to a question you only half understood can be quoted back months later as an “inconsistency.” Sky Law Group handles these calls every week for Spanish-speaking families in Orange, Santa Ana, Anaheim, and Garden Grove — and our attorneys speak Spanish themselves, not through a translator.
Whose insurance company is calling? It changes everything
The at-fault driver’s insurer (third-party). This company owes you nothing contractually. California law does not require you to give it a recorded statement, sign a blanket medical release, or accept its first offer. You can say, “I’m not giving a statement. Please send your request in writing.” That is a complete and lawful answer.
Your own insurer (first-party). Your policy has a cooperation clause, so refusing everything can put your uninsured/underinsured motorist or MedPay benefits at risk. But “cooperate” means reasonable cooperation — you can ask for the questions in writing, request a Spanish interpreter, and have an attorney present. See our guide to hit-and-run and uninsured motorist claims and what to do when the driver has no insurance.
Five traps hidden inside a “simple” recorded statement
- “How are you feeling?” — “Fine, thanks” is quoted as proof you were not hurt. Whiplash and concussion symptoms often surface days later (read about delayed-onset injuries).
- “Did you see the other car before impact?” — Builds a comparative-fault argument. Under California’s pure comparative negligence rule (Li v. Yellow Cab; Civ. Code §1431.2), even 20% blame cuts your recovery by 20%. See comparative negligence in California.
- “Do you have prior injuries?” — Invites a “pre-existing condition” defense for a bad back or knee.
- “Can you estimate your speed?” — Guesses become admissions.
- The medical-records release — An unlimited authorization lets them search ten years of records for anything to blame.

What a recorded statement can cost you (illustrative ranges)
These are general illustrations of how statements affect outcomes, not promises. Every case turns on its own facts.
| Injury | Typical range with documented treatment and counsel | Common range after a damaging statement |
|---|---|---|
| Soft-tissue / whiplash | $15,000 – $60,000 | $3,000 – $12,000 |
| Herniated disc | $75,000 – $300,000+ | $20,000 – $60,000 |
| Fracture requiring surgery | $150,000 – $500,000+ | $40,000 – $120,000 |
What California law gives you
- All-party consent to recording. Penal Code §632 requires every party’s consent to record a confidential call. An adjuster must tell you the call is being recorded — and you may decline.
- Fair-claims duties. Insurers must not misrepresent facts or coverage and must handle claims fairly (Ins. Code §790.03(h); 10 CCR §2695.7).
- Two years to sue for personal injury (CCP §335.1) — the adjuster’s “we’ll get back to you” does not stop that clock. See California’s statute of limitations.
- Your immigration status is not part of the claim. You can pursue an injury claim regardless of status; read our guide for undocumented accident victims.
Exactly what to say (copy this)
“I’m still receiving medical care and I’m not comfortable giving a statement today. Please put your questions in writing and send them to my attorney. Do not call me again.” Then hang up politely. In Spanish: “Estoy recibiendo atención médica y no daré una declaración hoy. Envíe sus preguntas por escrito a mi abogado.” Our Spanish version of this guide is here.
Also: do not post on social media, do not sign anything, and photograph the scene, the vehicles, and your injuries. Seek care at UCI Medical Center, St. Joseph Hospital, or Hoag or your own doctor the same day.

Frequently asked questions
Do I have to give a recorded statement after a car accident in California?
Not to the at-fault driver’s insurer. You may be asked by your own insurer under your policy’s cooperation clause, but you can request written questions, an interpreter, and an attorney’s presence.
Can I give my recorded statement in Spanish?
You can ask for a qualified Spanish interpreter or a Spanish-speaking adjuster. If they cannot provide one, decline the statement and route communications through your attorney.
What if I already gave a recorded statement?
Don’t panic. A statement is evidence, not a final verdict. Ask for a copy, tell your lawyer exactly what you said, and correct any errors in writing. Call us for a free review.
Can the insurance company record me without telling me?
No. Penal Code §632 requires consent of all parties to record a confidential communication. A recording without notice can be challenged.
Will refusing a statement hurt my claim?
Refusing the other driver’s insurer does not hurt a valid claim. Evidence comes from the police report, photos, witnesses, and medical records. What hurts claims is a rushed, inaccurate statement.
Should I sign the medical authorization the adjuster sends?
Not as written. Broad releases let insurers dig through unrelated history. Your attorney can limit it to relevant records and dates.
How long do I have to file a lawsuit?
Two years from the injury for most personal injury claims (CCP §335.1), and as little as six months for a claim against a city or public agency (Gov. Code §911.2).
Does my immigration status affect my right to compensation?
No. Injured people in California can pursue claims regardless of immigration status, and Sky Law Group does not ask about it to take your case.
What does a lawyer cost?
Nothing upfront. Sky Law Group works on contingency — no fee unless we recover for you — and the consultation is free.
What should I say if the adjuster keeps calling?
Say the script above once, then stop answering. Once you hire us, every call and letter goes to our office instead.
