Short answer: A traumatic brain injury (TBI) settlement after a California car accident commonly runs from $50,000 to $250,000 for a mild TBI or concussion with lasting symptoms, $250,000 to $1,000,000 for a moderate TBI, and $1,000,000 to $10,000,000 or more for a severe TBI that needs lifelong care. Your damages are measured under Civil Code §3333, and you generally have two years to file (CCP §335.1), or six months if a city, county, or Caltrans is involved (Gov. Code §911.2). Why TBI cases are valued so differently from other injuries
A broken arm heals and the bills stop. A brain injury often does not. Someone hit at Tustin Street and Katella Avenue, or rear-ended on the 55 near the 22 interchange, may walk out of UCI Medical Center or St. Joseph Hospital in Orange with a "mild" diagnosis and then spend years with headaches, memory gaps, light sensitivity, irritability, and trouble holding a job. The insurance company sees a normal CT scan. A jury should see a person whose life changed.
That gap is where most TBI claims are won or lost. Standard CT and MRI scans often look normal after a concussion-level injury, so the claim has to be built with neuropsychological testing, treating-physician opinions, and testimony from the people who knew you before the crash.
TBI settlement ranges in California by severity
There is no formula, and no honest lawyer can promise a number. These ranges are illustrative only. They reflect how serious TBI cases are commonly valued, and every result depends on the medical proof, the available insurance, and how fault is divided.
| TBI severity | Typical clinical picture | Illustrative settlement range |
|---|---|---|
| Mild (Glasgow Coma Scale 13–15) | Concussion with symptoms lasting months; headaches, memory and focus problems | $50,000 – $250,000 |
| Moderate (GCS 9–12) | Hospital stay, rehab, cognitive and emotional deficits, reduced ability to work | $250,000 – $1,000,000 |
| Severe (GCS 8 or below) | Extended coma or ICU care, permanent impairment, long-term attendant care | $1,000,000 – $10,000,000+ |
The Glasgow Coma Scale only measures the first hours after impact. It does not decide the value of your case. A person with a "mild" score who can no longer work as a nurse or an electrician can have a claim worth far more than the table suggests.
What goes into a TBI settlement
California lets an injured person recover both economic and non-economic damages (Civ. Code §3333; see our guide to damages in California personal injury cases). In a brain injury case the pieces are:
- Past and future medical costs: ER care, imaging, neurology, neuropsychology, therapy, medication, and rehab (CACI No. 3903A).
- Lost earnings and lost earning capacity: not only the paychecks you missed, but the career you can no longer pursue (CACI Nos. 3903C and 3903D).
- Life care plan: for moderate and severe injuries, a specialist prices out decades of care, equipment, home changes, and attendant help.
- Pain, suffering, and loss of enjoyment of life: often the largest component, valued by the jury (CACI No. 3905A).
- Your spouse’s claim: a husband or wife may have a separate claim for loss of consortium.
Mental health effects are part of the picture too. Many people with a brain injury also develop depression, anxiety, or trauma symptoms, which we cover in our guide to PTSD after a car accident.
What the insurance company will not tell you
Adjusters handle brain injury claims with a playbook. Watch for these moves:
- "Your scans are normal." A normal CT does not mean no injury. Diffuse and concussive injuries frequently do not show up on standard imaging.
- The early lowball. The offer often arrives before you know whether symptoms are permanent. A signed release ends the claim forever, even if you worsen later. See how adjusters work in our guide to insurance adjuster tricks in Orange County.
- The "pre-existing condition" argument. If you had prior headaches or anxiety, they will blame those. California law lets you recover for aggravation of a prior condition, and a defendant takes the victim as they find them.
- The surveillance video. Good days get filmed. Bad days do not.
Evidence that moves a TBI settlement
- Prompt, consistent treatment. See a doctor the same day, and tell every provider about every symptom, including memory, sleep, mood, and balance.
- Neuropsychological testing that measures attention, memory, and processing speed, ideally compared against your baseline.
- Before-and-after witnesses: family, coworkers, and friends who can describe the change.
- A symptom journal, kept daily, with dates and specifics.
- Employment records that show missed work, reduced duties, or a lost job.
Fault also matters. If someone argues you were partly to blame, California’s pure comparative negligence rule reduces your recovery by your percentage of fault (Civ. Code §1714; see comparative negligence in California). If the other driver was drunk, you may also have grounds for punitive damages under Civil Code §3294.
Deadlines that cannot be missed
You have two years from the date of the crash to file a lawsuit (CCP §335.1). If a government entity is involved, such as a city, OCTA, or Caltrans for a dangerous roadway, a written claim is due within six months (Gov. Code §911.2). Brain injury victims sometimes do not realize the full extent of their symptoms for weeks, which is one more reason not to wait. TBI settlement FAQs
How much is the average TBI settlement in California?
It depends on severity. Illustrative ranges are $50,000 to $250,000 for mild TBI, $250,000 to $1,000,000 for moderate, and $1,000,000 to $10,000,000 or more for severe, with the value driven by medical proof, permanence, and lost earning capacity.
Can I get a settlement for a concussion?
Yes. A concussion is a mild TBI. If symptoms last for months and are documented by a physician or neuropsychological testing, it can support a significant claim.
What if my CT scan or MRI was normal?
That is common and does not end your case. Mild and diffuse brain injuries often do not appear on standard imaging, so neuropsychological testing and clinical records carry the weight.
How long does a TBI settlement take?
Often 12 to 36 months. A responsible lawyer waits until you reach maximum medical improvement, because settling early means giving up compensation for future care you may need.
How is pain and suffering calculated in a brain injury case?
There is no multiplier set by law. A jury considers the severity, permanence, and how the injury changed your daily life (CACI No. 3905A), and negotiations use the same factors.
What is a life care plan?
It is a specialist’s cost estimate for your future medical care, therapy, equipment, home modifications, and attendant help. It is central to moderate and severe TBI claims.
Can I recover if I had a prior head injury or condition?
Yes, for the aggravation of a prior condition. California law holds a defendant responsible for making an already vulnerable person worse.
How long do I have to file a TBI claim in California?
Two years from the date of injury (CCP §335.1), and only six months to present a claim if a public entity is involved (Gov. Code §911.2).
Does my immigration status affect my brain injury claim?
No. California law bars the defense from raising immigration status to defeat your claim (Evid. Code §351.2). Our Spanish-speaking attorneys will explain every step.
What does it cost to hire a TBI lawyer?
Nothing up front. The consultation is free, and Sky Law Group is paid only if we recover money for you.
