Arguments over who had the right of way are at the center of many Orange County crashes: four-way stops, left turns, parking lot lanes, and signals that were broken or confusing. Each driver usually believes the other one was wrong, and insurers use that confusion to reduce or deny claims.
California has specific rules for who must yield. Knowing them, and gathering evidence quickly, can change the outcome of your claim.
Common Right-of-Way Rules in California
- Left turns: a driver turning left must yield to oncoming traffic that is close enough to be a hazard (Vehicle Code §21801).
- All-way stops: the driver who arrives first generally goes first, and if two arrive at the same time the driver on the left yields to the driver on the right (Vehicle Code §21802).
- Uncontrolled intersections: a driver must yield to a vehicle that has already entered the intersection (Vehicle Code §21800).
- Pedestrians in crosswalks generally have the right of way. See our pedestrian accident guide.
Local conditions matter: a faded stop sign, blocked view or malfunctioning signal can change who is responsible, and sometimes a city is also partly responsible.
Shared Fault Is Common
California uses comparative negligence. If a jury or insurer decides you were partly at fault, your compensation is generally reduced by your percentage of fault, but not automatically eliminated. That is why you should never accept an adjuster’s version of who was “mostly at fault” without checking the facts.
Evidence That Helps
- Photos of the intersection, signs, signals and sightlines
- Video from nearby businesses, buses, doorbells and dashcams
- Witnesses who saw who arrived first or who ran the signal
- The police report and any citations, although a citation is not the final word on fault
- A prompt medical record linking your injuries to the crash

What to Do Right Now
- Get medical care, even if you feel fine. Some injuries show up hours or days later.
- Document everything: photos, plates, insurance cards, witness names and phone numbers.
- Report the crash and keep the report number. See our guide on insurance adjuster tricks before you talk to any insurer.
- Do not admit fault or sign a release until you understand what your claim is worth. Read should I give a recorded statement?

California Filing Deadlines
Most California injury lawsuits must be filed within two years of the injury (Code of Civil Procedure §335.1). If a city, county or other public entity is involved, a claim generally must be presented within six months (Government Code §911.2). Read our statute of limitations guide. Every case is different and no result can be guaranteed.

Frequently Asked Questions
Who has the right of way at a four-way stop in California?
Generally the driver who arrives first goes first. If two drivers arrive at the same time, the driver on the left yields to the driver on the right. Always check the facts of your crash.
What if the other driver got a ticket? Does that prove fault?
A ticket helps but does not by itself decide your claim. Insurers and courts look at all of the evidence.
What if both of us think the other ran the stop sign?
These disputes depend on evidence such as video, witnesses, damage patterns and physical evidence. A lawyer can gather it before it disappears.
How much does it cost to hire Sky Law Group?
The consultation is free and we work on contingency, so you pay no attorney fee unless we recover compensation for you.
