The insurance company says you were not wearing a seat belt? That does not erase your claim. Call Sky Law Group at (844) 475-9529. Free consultation, 24 hours a day. No fee unless we win. Hablamos Español.

Insurance adjusters like to bring up seat belts. If you were not buckled, or they say you were not, they may try to shrink your claim or deny it completely. In California, that is usually not how the law works.

Wearing a seat belt is required by Vehicle Code §27315, and not wearing one can matter in a claim. But it does not excuse the driver who caused the crash.

Does Not Wearing a Seat Belt Ruin Your Claim?

No. The other driver caused the crash by driving negligently, not you by being unbuckled. At most, an insurer may argue that some of your injuries would have been less severe with a belt on, and ask to reduce the part of your compensation tied to those injuries.

  • The belt issue usually affects only injuries a belt would have prevented, not the whole claim
  • It does not change who caused the crash
  • The insurer must still prove that the belt would have made a difference
  • Injuries such as broken bones from impact with the other vehicle are separate from the belt argument

Because this is a factual and medical question, insurers often overreach. Do not accept an adjuster’s statement that you are barred from recovery.

Children and Passengers

If a child or another passenger was hurt, special rules apply for car seats and booster seats. The responsibility of a driver for an unbuckled passenger can be a separate issue from the other driver’s fault. Call us and we will review what applies to your family.

How to Protect Your Claim

  • Do not guess or speculate in a recorded statement about your seat belt. See should I give a recorded statement?
  • Keep your medical records and the police report
  • Photos of the vehicle interior, belt and airbag can matter
  • Do not sign a release before a lawyer reviews the offer

What to Do Right Now

  1. Get medical care, even if you feel fine. Some injuries show up hours or days later.
  2. Document everything: photos, plates, insurance cards, witness names and phone numbers.
  3. Report the crash and keep the report number. See our guide on insurance adjuster tricks before you talk to any insurer.
  4. Do not admit fault or sign a release until you understand what your claim is worth. Read should I give a recorded statement?
  5. Call Sky Law Group for a free consultation: (844) 475-9529.

California Filing Deadlines

Most California injury lawsuits must be filed within two years of the injury (Code of Civil Procedure §335.1). If a city, county or other public entity is involved, a claim generally must be presented within six months (Government Code §911.2). Read our statute of limitations guide. Every case is different and no result can be guaranteed.

Frequently Asked Questions

Can I still get compensation if I was not wearing a seat belt?

Often yes. The other driver’s negligence is still the cause of the crash. The belt issue may reduce part of the compensation tied to injuries a belt would have prevented, but it does not automatically end your claim.

Does an insurance adjuster have to prove I was unbuckled?

If the insurer raises the issue, it generally must support the argument. Do not volunteer details that are not accurate.

What if a doctor’s records say nothing about a seat belt?

That can help, but the record is only one piece of evidence. Tell us exactly what happened so we can respond.

How much does it cost to hire Sky Law Group?

The consultation is free and we work on contingency, so you pay no attorney fee unless we recover compensation for you.
